Far too many administrative agencies believe that they have the authority to to whatever they want without accountability. They also view elected officials as being temporary government employees, while bureaucrats can remain in their jobs for many decades.

One can be sure that administrative agencies will be looking for every possible way to retain their power. As the Alliance for Natural Health has pointed out, one way administrative agencies can try to negate the impacts of the Supreme Court’s decision is to issue guidance documents, which do not require formal rule-making.

One of the key features of administrative agencies is that they seek to exercise the maximum power they can muster.
