THE TOPLINE

  • ANH-USA has filed a historic legal challenge to restore the public’s right to know about 118 science-backed nutrient health claims—statements made by the government’s own health agencies but censored by the FDA for nearly 30 years.
  • The FDA’s unlawful censorship has hidden proven nutrient-disease connections, protecting pharmaceutical profits while depriving consumers of safe, affordable, and natural health options.
  • If successful, this case would unlock truthful information, empower consumers, and allow supplements to stand on equal footing with drugs in supporting health and preventing disease.
  • We need as many people as possible to respond to our Action Alert to put pressure on HHS and FDA.

We’ve recently shared exciting news about our historic legal filing with the FDA—one that seeks to restore your right to know the truth about the healing power of nutrients. These aren’t marketing slogans, but science-backed claims from the government’s own health agencies, claims the FDA has illegally kept off supplement labels where consumers need them most.

Our filing identifies 118 distinct claims on nutrient-disease relationships made by government agencies on a variety of nutrients, carefully cataloguing the scientific studies that support the claims. You can get a sense of the scale of this project from this picture of ANH’s General Counsel, Jonathan Emord, with the printed out filing and supporting evidence.

For nearly 30 years, the FDA has been breaking the law in censoring these claims. In passing the Food and Drug Administration Modernization Act in 1997, Congress explicitly permitted food and supplement labels to use health claims based on “authoritative statements” from trusted federal scientific bodies. Yet in 1998, the FDA issued guidance that effectively nullified this provision of the law, blocking companies from making the same claims that had been vetted by government agencies.

The end result is that millions of Americans are denied information that could benefit, even transform, their health.

The FDA’s censorship keeps consumers in the dark, but it also protects the pharmaceutical industry’s multibillion-dollar monopoly on healthcare. Many of the health conditions targeted by these censored nutrient claims are the same ones driving record-breaking drug sales.

  • Diabetes drugs: GLP-1s like Ozempic ($18.6 billion in 2024 sales) and Mounjaro ($11.5 billion in sales) dominate the airwaves, while Jardiance brought in $13 billion treating diabetes, heart failure, and kidney disease. Yet, as demonstrated in our filing, the government recognizes that nutrients such as chromium, magnesium, zinc, and green coffee bean extract have documented benefits for blood sugar management.
  • Inflammation drugs: Blockbusters like Dupixent ($15 billion in 2024 sales) and Stelara ($10 billion) target inflammation. But government-vetted research shows compounds like boron, selenium, Asian ginseng, and omega-3 fatty acids can also help reduce inflammatory processes.
  • Heart drugs: The global cardiovascular drug market was valued at $144 billion in 2023 and is projected to soar to $207 billion by 2033. Meanwhile, nutrients including vitamin B1, vitamin B12, magnesium, potassium, grape seed antioxidants, vitamin E, and vitamin D have strong links to heart and vascular health.

If we’re successful, consumers will finally have access to truthful, science-backed information about how nutrients can help manage the very same conditions targeted by blockbuster drugs. It would mean supplements and drugs could compete on a more level playing field. Instead of keeping safe, affordable, and widely accessible options in the shadows, the FDA would have to allow them into the light, where the public can make informed choices about their own health.

For too long, a door has been locked. Behind it lies a world of health and healing that doesn’t depend on expensive drugs or endless prescriptions, but on safe, natural, and affordable nutrients that support the body’s innate ability to thrive. That world has been hidden from us—not because the science isn’t there, but because FDA censorship has kept the key out of our hands.

This legal filing is that key. It challenges decades of unlawful censorship and seeks to open the door to a new era in which consumers can finally learn the truth about how nutrients prevent disease, restore balance, and promote wellness.

If successful, this case won’t just unlock 118 specific health claims. It will unlock the freedom to reimagine healthcare itself—where natural options stand shoulder-to-shoulder with pharmaceuticals, and where people are empowered with the knowledge they need to make the best choices for themselves and their families.

The tragic loss of Charlie Kirk is a sobering reminder that, regardless of where one stands on the political spectrum, we must come together to protect freedom of speech, uphold the rule of law, and defend the constitutional rights that allow all voices to be heard in a safe and respectful society.
